General terms and conditions
Please read the below clauses before the hunting and take notice of them.
You acknowledge and accept the contractual conditions by booking the hunt.
1, Order
Nomád Hunting Kft. arranges hunting events and sells game animals. Upon booking your hunt by your signature, you acknowledge that you read and accepted the general terms and conditions. We confirm your booking based on the above and we consider the contract as concluded. You are entitled to cancel your booking in compliance with the cancellation policy.
We need the necessary data and documents (passport, data of the firearms) 30 days prior to the date of the hunting in order we can arrange all formalities of your travel.
In case you provide the above data delayed, we cannot guarantee the proper organization of your booked hunting.
2, Terms of payment
Upon confirmation of the hunt, the payment of the advance payment becomes due. The delivery of the travel documentation takes place after the transfer of the total advance payment.
The settlement shall be effected based on the records (shot chart) signed by you at the hunting location. The final amount becomes due upon taking over the invoice.
Regarding the payment, we cannot take into consideration any direct agreement with the management of the hunting location or with a third person or any amount paid directly to the hunting service provider or a third person (contrary to our preliminary agreement).
3, Services
The services are unambiguously set out in the offer and in the confirmation of the hunt. We cannot take into consideration any request that you agreed upon with the management of the hunting location or with a third person. Of course if you have any further requests, we will be pleased to fulfil these.
4, Change of price
Nomád Hunting Kft. maintains the right to increase the confirmed price (due to grounds that do not fall into our scope of activities – increase of gas price, airport duty) in case the hunt is at least 2 months later than the effective date of the contract. We do not change the prices within 20 days prior to the travel.
5, Hunting records, shot chart
This document serves for the basis for the issuance of the final invoice. All successful shots and requested services are to be enlisted in it (also for your sake as well).
You verify the correctness of these data by your signature together with the representative of the hunting location. You may file objections only by means of this document.
As far as possible you should inform the manager of the hunting location about your objections and requests.
Unfortunately we are not able to take into consideration any objection that is not included in the records.
We suggest you should inform our office about your remarks.
6, Liability
Pursuant to the concluded travel and hunting agency contract, we undertake an agent activity in order to pick the hunts that are most suitable for you and to determine your requested services. We cannot guarantee the number of shot game animals, nor the size or weight of the requested trophies and you will be not entitled to pursue damages in this regard. The guest hunter shall be responsible for each and every shot. If the professional hunter companion gives permission to shoot a game animal, then it means that it is available. The responsibility of the actual shot is yours. In case you decide for the shot, you take the consequences of failing, wounding and regarding the size and quality of the trophy.
On your request our office can organize the transport of the trophies to your home address. Our liability is excluded in the following cases: harm due to improper handling, breaks and harm during transport, or if the package gets lost.
The hunting trips come with an above average risk, therefore the prudent and cautious behaviour is a must. Our liability is excluded regarding any possible harm in your health, in your equipment or harm caused to third persons due to the neglection of these risk factors.
7, Obligations of the guest hunter
The guest hunters are obliged to provide their assistance regarding the removal of any possible hindering circumstance during the travel. Furthermore, they are obliged to comply with the hunting regulations of the concerned country. Based on their behaviour or intoxication, they can be excluded from further hunting or further requested services can be denied. Guest hunters are obliged to pay full sum of the hunting that have been disrupted due to the aforementioned circumstances, and additional costs as well (e.g. change of flight date).
8, The agent’s cancellation of the contract
Our office and our service provider partners maintain the right to cancel the contract at any time due to the appearance of any unforeseeable, hindering circumstance (plagues, natural catastrophes, conflicts of war) that might seriously endanger the safe and successful hunting. However, we will give our best to provide you with an offer for a similar hunt of at least the same quality that can be accepted by both of us. In case we would not be able to present a proper offer, the already effected advance payments shall be reimbursed. Further damages against our office are excluded.
9, The hunter’s cancellation
The orderer is entitled to cancel the contract at any time upon meeting the cancellation policy. We can accept a cancellation of an already booked trip only in writing. The date of the receipt shall be considered as the date of cancellation. Upon cancellation, if not otherwise agreed, the following expenditures shall be invoiced:
a, until the 61. day before the trip a cancellation cost in the amount of 30% of the basic hunting price shall be charged.
b, between 60-31. days before the trip a cancellation cost in the amount of 50% of the basic hunting price shall be charged.
c, within 31 days before the trip a cancellation cost in the full amount of the basic hunting price shall be charged. The already paid down payment shall not be reimbursed.
These charges have to be effected, because the hunting permits are issued to the respective hunter before the hunting and they are not transferable. In these cases the service provider has to account financial loss.
10, Interruption of the trip
In case of interruption by the guest hunter on any ground, the total price (organization + hunting + accommodation etc.) is to be paid.
11, Force majeur
If the trip is interrupted due to forces of nature or other unforeseeable hindrances (war, strike, catastrophe, plague) or technical problems (failure of the airplane etc.) all consequences and costs shall be borne by the guest hunters.
12, Insurances
Our programs and services do not include any insurance. The guest hunters are obliged to take out an insurance for their own sake. Our liability in case of any damage due to any fault of the guest hunter, the hunting service provider or any other service provider, is excluded. We suggest taking out cancellation insurance and a health and luggage insurance.
13, Miscellaneous
We maintain the right for amendment of the programs and prices in the catalogue or the occurrence of any mistakes therein.
